PRIVACY POLICY OF SNAP-E

1. INTRODUCTION:

1.1 By using the Application (hereinafter referred to as the "Application" or "App" as the context may indicate), you consent to us collecting, processing, and disclosing the Personal Information you submit to the Application (hereinafter referred to as the "Application") on the terms set out below. If you do not agree to the conditions set out in this Privacy Policy then please do not make use of the Application. This Application allows users to access certain content and rewards via their mobile device and a television advertisement interface.

1.2 Personal information collected via the Application is controlled by e.tv (Pty) Ltd at 4 Albury Road, Dunkeld West, Johannesburg ("we/us/our"). we recognize that privacy is extremely important. This Privacy Policy applies to all of the software, content, information, tools, features and functionality located on the Application and extends to any ancillary features of the Application.

1.3 Any term defined in our Terms and Conditions ("the Terms") and referred to in this Privacy Policy shall bear the meaning as defined in the Terms.

2. INFORMATION WE COLLECT

2.1 Any Personal Information we collect is used to provide you with a beneficial, personalised and meaningful Application. We use the information that you provide or that we collect to operate, maintain, enhance, and provide all of the features found on the Application. The kind of information we may collect through the Application includes, but is not limited to, the following categories of Personal Information:

A. Registration information: When you register for the Application, you will be asked for basic registration information, such as a cellphone number, your full name, and a password to control access to your account. We ask only for data that is adequate, relevant and not excessive for those purposes.

B. Technical and navigational information: We collect information about your interaction with the Application such as Device type, pages visited, which of Our Content you access and for how long, average time spent on our Application, IP address, unique identifier of your Device/s, operating system version and Application version.

C. Location information: If you choose to use a location enabled Device, we may collect location information from your Device and will notify you of this collection. You may control or disable the sharing of location information via your Device setting and/or the Platform.

D. Aggregate Information: When you use our Applications, we automatically receive and record aggregate information including, without limitation, in respect of: (i) account activities, your users' activities with regards to any type of scanning that was done using the Application; (ii) documents and browser, including your cookie information, software and hardware attributes; (iii) location. We use all of the information that we collect to understand the usage trends and preferences of our users and their users, to improve the way the Site and the Application works and looks, and to potentially inform customers about statistical information regarding users' exposure to the Applications and to create new features and functionality.

E. Document Download: We may download/store cache content you created or uploaded to the Application on our servers for the sole purpose of improving the functionality of the Application.

F. Other information: We may request or receive other Personal Information such as feedback, questions, comments, suggestions, or ideas to provide you with other benefits or to improve upon the Application. In such instances, you will be given the opportunity to provide or decline that information.

3. HOW WE USE THE INFORMATION WE COLLECT

We shall use your Personal Information to:

3.1 fulfil your requests for the Application; respond to your inquiries about the Application; analyse Application usage; alert you to software compatibility issues and to improve our Application functionality; deliver to you any administrative notices or alerts and communications relevant to your use of the Application; offer you other products, programs, or Applications that we believe may be of interest to you.

3.2 detect and protect against errors, fraud, or other criminal activity;

4. HOW WE DISCLOSE PERSONAL INFORMATION

4.1 We will not sell, publish, or share your Personal Information with third parties for their marketing purposes.

4.2 We may share your Personal Information with other third parties with your consent or instructions to do so, or where it is lawful.

4.3 We may transfer your Personal Information to countries which have similar data protection laws to South Africa.

4.4 You have the right to access any of your Personal Information in our possession at any time and you may require us to correct any incorrect information we may have.

4.5 Your personal information is stored in accordance with high standards of security that are at least, or higher than the standards of what is accepted within the media industry for storage of data of this nature. At all times, your personal information will be processed in the most minimalistic manner possible and with due regard to the intended purpose of the information being shared and the intention of the Protection of Personal lnformation Act 4 of 2013.

5. SECURITY OF PERSONAL INFORMATION

5.1 We use technical and administrative security measures such as but not limited to firewalls, encryption techniques, and authentication procedures, among others, to maintain the security of your Personal Information.

5.2 We receive Personal Information from you in the provision of the Application. While we make every effort to protect such Personal Information, it is possible for internet-based communications to be intercepted. Without the use of encryption, the internet is not a secure medium and privacy cannot be guaranteed. We will not be responsible for any damages suffered by you or any third party or Additional Users as a result of the transmission of Personal Information through the internet or for any errors or changes made to any transmitted information.

5.4 We may make use of cookies and other means to track your use of the Application and to improve the Application offered to you. We may use cookies and other means to: (a) automatically update the Application on your system; (b) remember your information so that you will not have to re-enter it during your visit or the next time you access; (c) monitor aggregate site usage metrics such as total number of visitors and pages accessed; (d) track your entries, submissions, and status in any promotions or other activities

6. NEWSLETTERS, SUMMARIES, AND NOTIFICATIONS

6.1 We may send periodic Application related alerts, summaries, notifications, newsletters, promotions, or other information related to the Application via email or SMS. You may choose to stop receiving alerts, summaries, newsletters and promotions by indicating your preference in your account profile or settings. Please note that certain Application-related messages that we send are necessary for the proper functioning and use of the Application and you may not have the ability to opt-out of those messages.

7. THIRD-PARTY OFFERS, ADVERTISEMENTS, AND DATA COLLECTION

7.1 We may offer a number of separate products and Applications offered by third parties advertised to you on our Platforms. These third party offers may be complementary to your use of the Application and may be personalised based on information you provide to us, we have collected about you, queries made through the Platforms, or other information. If you choose to use these separate products and Applications, provide information to the third party, or allow the third party to otherwise collect information about you, then their use of your information is subject to the applicable third party"s privacy policy and terms of Application. You should review the practices of the third party before deciding to use their Application or provide them with any information.

7.2 We may use third party Application providers to help us analyse certain online activities. For example, these Application providers may help us measure the performance of our online promotions or analyse the Application and/or Platform activity. We may permit these Application providers to use cookies and similar technologies to perform these Applications.

7.3 You may access, review, and update any of the Personal Information you have submitted to us at any time via the Platforms. Some of the Personal Information you provide to us is essential for us to provide the Application to you. If you no longer want us to have access to such Personal Information, you will no longer be able to access the Application.

7.4 You may choose to close or request that we delete your account for the Application at any time. When you delete your account, we will automatically delete all of your Personal Information.

7.5 We may only share personal information with other companies or individuals in each of the following limited circumstances:

a) We have obtained your consent.
b) We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf solely for the purpose of providing the Application. We require that these parties agree to process such information based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures.
c) We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable agreements and/or their terms, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of ourselves, our users or the public as required or permitted by law.

 

8. COMPLAINTS AND JURISDICTION

    1. If you think that we are processing your Personal Information in an unlawful or unfair manner, we invite you to first contact us to attempt to resolve the matter.

8.4 These Terms shall be governed and interpreted in accordance with the laws of the South Africa and the parties hereby consent to the jurisdiction of the South African Courts in the event of any dispute or litigation arising out of these Terms. The Parties agree that any legal action or proceedings arising out of or in connection with this Agreement may be brought to the South Gauteng High Court, Johannesburg (or any successor to that court), and irrevocably submit to the non-exclusive jurisdiction of such court.

9. DATA DELETION

We will retain your information for the period required to fulfill the purposes set out in this Policy and when there is a legal obligation to do so.  

Should you ever decide to delete your Account, you may do so by opening Snap-e application and clicking on Privacy Policy menu.
